Kingston's CIL Charging Schedule Review (Regulation 16)
Overview
Kingston Council has had a Community Infrastructure Levy (CIL) charging schedule in place since November 2015, which sets out the CIL rates that apply to different types of development across the borough and helps determine the level of contribution required from new development.
We are now proposing an updated CIL Charging Schedule to make sure the levy rates reflect the borough’s future growth, housing needs, and infrastructure requirements.
What is the Community Infrastructure Levy?
The Community Infrastructure Levy (CIL) is a contribution from developers when new homes, businesses or other forms of development are built. CIL helps councils provide the infrastructure and facilities that communities need as local areas grow, supporting strong, well-connected and thriving communities. This could include new or improved roads, schools, parks, community facilities, and other local services.

Regulation 16 consultation
The proposal has been informed by the new draft Kingston Local Plan 2028 - 2043, which sets out plans for how Kingston will grow and develop over the next 15 years. The draft Local Plan has recently completed its Regulation 19 consultation, which is the formal consultation stage before the plan is submitted for independent examination. At present, it is intended that the Local Plan and the CIL charging schedule will be submitted together for examination.
At this stage, which is called a Regulation 16 consultation, we are consulting on our draft CIL Charging Schedule and the evidence that supports our proposed CIL rates.
What are the key changes when compared with the existing CIL Charging Schedule?
The proposed Charging Schedule would update the CIL rates that apply to new development in Kingston. The main changes are:
- Residential: CIL rates would increase by approximately 10–12.5% across all zones.
- Commercial development in designated areas and student housing: CIL rates would decrease by around 5–10% on average.
- Retail in Kingston Town Centre’s Primary Shopping Area: the CIL rate would reduce significantly, from £307/m² to £80/m².
- All other uses: the CIL rate would increase by around £9/m² (approximately 33%).
- New types of development: new CIL rates would be introduced for emerging uses such as last-mile distribution centres, data centres and co-living developments. These are currently charged under the general ‘all other uses’ rate.
What does this mean compared with the current rates?
The CIL rates in the existing 2015 Charging Schedule are increased each year through indexation, as required by the CIL Regulations. Indexation reflects changes in construction costs and means that the rates charged today are higher than the figures originally set in 2015.
For 2026, the current indexation multiplier is 1.538 (400/260). This means that the existing 2015 rates have increased by around 54% through indexation.
The percentage changes above compare the proposed new rates with the current 2026 rates after indexation has been applied, rather than with the original rates published in 2015.
Education, medical and community facilities
There will continue to be no CIL charge (£0/m²) for education, medical and community facilities.

CIL Examination: Right to be heard
Any person or organisation making a comment (representation) on the Draft Charging Schedule has the right to request to be heard by an independent examiner at the examination in public.
When submitting your comments, please clearly state if you wish to exercise this right to be heard. You may also request to be notified at a specified address when the draft schedule is submitted to the examiner, when the examiner’s recommendations are published, and when the updated schedule is approved.
Next steps
Following the completion of this Consultation, the Council will collate and consider all responses, make any necessary amendments and will aim to submit the Charging Schedule to the Inspectorate alongside the Draft Local Plan at the end of the year.
